JUSTICE PRABHAT KUMAR JHA ORAL ORDER 29-11-2016 Heard Sri Krishna Prasad Singh, the learned senior counsel for the petitioner, Sri Akhileshwar Prasad Singh, the learned senior counsel for the informant, and the learned Additional Public Prosecutor.
The petitioner seeks bail in S. Tr. No. 07 of 2016/ 03 of 2016, arising out of Barun P.S. case No. 72 of 2015, under Section 365 of the Indian Penal Code and under Section 27 of the Arms Act. Later on Section 302, 201/34 of the IPC was added. The learned senior counsel for the petitioner submits that prayer of petitioner for bail was earlier rejected by this court vide order dated 01.03.2016 passed in Cr. Misc. No. 54616 of 2015. All the prosecution witnesses have been examined and the case is fixed for statement of the accused persons.
Patna High Court Cr.Misc. No.39710 of 2016 (3) dt.29-11-2016 2/2 Sri Akhileshwar Prasad Singh, the learned senior counsel for the informant, submits that statements of the accused have already been recorded on 17.11.2016.
Considering the fact that the trial is at fag end, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
