The petitioner apprehends his arrest in Ara Nawada P.S. Case No.302 of 2019 registered under Sections 25(1-b)a, 26, 25(1-aa) of the Arms Act.
The police, on secret information, raided the house of the petitioner(Ram Surat Ram) but the petitioner managed to flee away from the back side of the house. On search, many arms and ammunition were recovered from the house of the petitioner.
The learned counsel for the petitioner submits that house is joint family property and for that, petitioner cannot be held responsible for recovery of the arms and ammunition but it appears that on secret information that petitioner had kept arms and ammunition in his house, the house of the petitioner was
Patna High Court CR. MISC. No.48925 of 2019(2) dt.06-08-2019 2/2 raided and many pistols and live cartridges were recovered from the house of the petitioner.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
