JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2018 The petitioner is apprehending his arrest in connection with Mohammadpur P.S. Case No. 66 of 2016, registered for offences punishable under Sections 420, 467 and 468 of the Indian Penal Code.
Allegation against the petitioner is of manipulation in the Branch of Uttar Gramin Bank and in the account of other persons and misappropriation of Rs. 48,74,835/-.
Submission of learned counsel for the petitioner is that the period of embezzlement is of the year 2011 to 2014 and case was registered in the year 2016 whereas in January, 2016, petitioner had himself informed the Regional Manager of the Bank and given an application, and only due to the said reason he has
Patna High Court Cr.Misc. No.17746 of 2017 (5) dt.17-09-2018 2/2 been made accused in this case. It has further been submitted that there is no complaint on behalf of any of the customers and money has already been returned.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner by stating that on local enquiry in audit 2016, the allegation was found true. Having heard both sides, in view of the facts and circumstances, let the petitioner be surrendered within a period of six weeks from the date of receipt/production of a copy of this order and on surrender, he will be released on provisional bail till submission of charge-sheet, in the meantime, he will deposits all the papers to the Investigating Officer and cooperate in the investigation, however, inspite of that, if the charge-sheet has been submitted and the allegation against the petitioner is found to be true, then he will have to surrender and pray for regular bail, which would be considered on basis of materials available on record.
