JUSTICE SANJAY PRIYA ORAL ORDER 05-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Supaul P.S. Case No. 540 of 2015 instituted for the offence under Section 392 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody in the instant case since 3.2.2017. He is not named in the written report. No Test Identification Parade has been held. There is no recovery from possession of the petitioner. Keeping in view the period spent by the petitioner in custody in the instant case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief
Patna High Court Cr.Misc. No.65655 of 2018 (2) dt.05-11-2018 2/2 Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 540 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
The petitioner will cooperate in conclusion of the trial. He will remain present (i) on each and every date of trial till disposal of the case. (ii) He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial.
