Petitioner, who is in custody, seeks bail in connection with Kahalgoan (Ghogha) P.S. Case No. 17 of 2015 registered for the offences punishable under Sections 147, 148, 149, 307 and 427 of the Indian Penal Code and under Section 27 of the Arms Act.

Informant has alleged in his written complaint that while he was returning 4-5 FIR named persons tried to stop his car but seeing that they were armed, he did not stop the car and thereupon petitioner and co-accused fired on the car which hit his car.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to village

Patna High Court Cr.Misc. No.68319 of 2018(2) dt.29-11-2018 2/2 rivalry and the allegation of firing is concocted. He is in custody since 22.06.2015. He is accused in two other cases one under Section 498A and 120(b) and other under Section 387 of the Indian Penal Code.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class (Anwar Shamim), Bhagalpur, in connection with Kahalgoan (Ghogha) P.S.
