====================================================== CORAM: HONOURABLE MR. JUSTICE RAJ KUMAR ORAL ORDER 29-07-2026 Heard learned counsel for the petitioner as well as learned A.P.P. on behalf of the State.
2. The petitioner has been made an accused for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the allegations made in the F.I.R., 208 litres of Canned Beer have been recovered near Bank of River Ganga at the instance of the petitioner who was apprehended near the spot.
4. Learned counsel for the petitioner submits that no recovery has been made from the conscious possession of the petitioner and the petitioner has been implicated in this case. The learned counsel next submitted that provisions of Section
Patna High Court CR. MISC. No.51977 of 2026(2) dt.29-07-2026 2/3 103 of the B.N.S. has not been complied with. The petitioner is in custody since 28.06.2026 and he undertakes not to repeat the offence.
5. Learned counsel for the State opposes the prayer for bail of the petitioner and states that the petitioner is involved in one another case under Section 302 of the I.P.C.

Taking into consideration the entire facts and the recovery, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Court of Special Excise Judge, Danapur, Patna in connection with Special Excise Case No. 2471 of 2026 arising out of Shahpur P.S. Case No. 263 of 2026 subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial.
(ii) One of the bailors must be close relatives of the petitioner such as mother, father, brother, sister or wife. (iii) The petitioner will appear on each and every date fixed by the trial court and if, he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.
