JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324 and 504/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the accused persons started constructing hut on the land of the informant when protest was made then the informant was assaulted.
It is submitted by the learned counsel for the petitioners that no injury has been caused to any one from the informant side.
Patna High Court Cr.Misc. No.27230 of 2015 (2) dt.22-07-2015 2/2 Statement to the aforesaid effect has been made in paragraph 4 of the supplementary affidavit and petitioner no. 2 Raj Kumar Rai filed Taraiya P.S. Case No. 35 of 2015 against the informant at earlier point of time and mother of the petitioners also filed Case No. 1147 of 2014 before the DCLR.
Considering the accusation in the background of land dispute and litigated relationship between the parties, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Taraiya P.S. Case No. 36 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
