JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sono P.S. Case No. 01 of 2018 instituted for the offence under Sections 121 121(A), 120(A), 120(B) of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act.

It is alleged in the written report that Police on receiving secret information that some Naxalites have assembled in the forest for committing crime proceeded near the forest. On seeing the Police Party, three persons started fleeing away. One person was apprehended by the police who disclosed his name as Kamal Burnwal. He has disclosed the name of this petitioner. Counsel for the petitioner submits that one person was apprehended by the police who disclosed his name as Kamal

Counsel for the petitioner further submits that 2 Jiletin, 2 Electric Detonator , 15 meter electric wire in black and red colur and ten Naxal letter pad, 10 pieces Samsung Mobile have been recovered from possession of co-accused Kamal Burnwal. He has disclosed the name of this petitioner as a person who had fled away. Kamal Burnwal has already been granted bail by coordinate Bench of this Court vide order dated 28.06.2018 passed in Cr. Misc. 16872 of 2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Jamui, in connection with Sono P.S. Case No. 01 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
