Petitioner is in jail custody since 4.2.2014 but admittedly, neither he was caught on the spot nor anything was recovered from his conscious possession.

Name of the petitioner came in this case in confessional statement of co-accused who was caught by the officials on the spot. Petitioner carries criminal antecedent of near about 26 cases. The contention on behalf of the petitioner is that petitioner has already been granted bail in almost all cases and, as a matter of fact, police is in habit of in remanding the petitioner in false cases. Learned counsel for the petitioner submits that the petitioner has been granted bail in Triveniganj P.S. case no. 23/2003 by a bench of this court vide order dated 19.1.2015 passed in Cr. Misc. no. 1960/2015

Patna High Court Cr.Misc. No.37862 of 2014 (3) dt.06-02-2015 taking note of criminal antecedent of the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Birpur ( Supaul) in Raghopur P.S.
