====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 26-10-2024 Heard Mr. Mritunjay Kumar, learned counsel appearing on behalf of the petitioner and Mr. Rabindra Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Raghopur P.S. (Rustampur O.P.) Case No. 06 of 2013 registered for the offence punishable under Sections 272, 273 and 308 of the Indian Penal Code and Section 47(A) of the Bihar Excise Act.

3. Allegation is of recovery of 100 litres of country made liquor from a bag.

4. Learned counsel appearing on behalf of the petitioner seeks to withdraw the present bail application with liberty to seek regular bail before the learned District Court in the circumstances that F.I.R. is of the year 2013 and the

Patna High Court CR. MISC. No.57032 of 2024(4) dt.26-10-2024 2/2 petitioner had no knowledge of the said F.I.R. and there is no question of being apprehended.

5. That being the case, learned District Court is directed to call for the records of the case and in case the petitioner surrenders and seek regular bail, the same should be considered on the same day by passing a reasoned order in accordance with law.

6. The bail application stands disposed of.
