JUSTICE SANJAY PRIYA ORAL ORDER 05-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chautarwa (Bhairoganj) P.S. Case No. 38 of 2015 instituted for the offence under Section 394 of the Indian Penal Code. Subsequently, Sections 25(1-b)a, 26 and 35 of the Arms Act.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from his possession. His name has come in the confessional statement of co-accused Sunil Chaudhary. Petitioner is said to be in custody since 20.08.2015. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.66075 of 2018 (2) dt.05-11-2018 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bagaha, West Chamapran, in connection with Chautarwa (Bhairoganj) P.S. Case No. 38 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
