The petitioner seeks bail in connection with Adapur P.S. Case No.142 of 2016 registered under Sections 419, 272 and 273/34 of the Indian Penal Code besides Sections 47(A)/54 of the Bihar Excise (Amendment) Act, 2016.
In course of checking of the vehicle, one motorcycle and one Bolero vehicle were stopped by the police. Thereafter, the driver of the Bolero vehicle fled away taking the advantage of the darkness and the petitioner, who was with the motorcycle, could not produce the paper of the motorcycle. On search of the
Patna High Court Cr.Misc. No.129 of 2017 (2) dt.11-01-2017 2/2 motorcycle, 30 bottles, each containing 300 m. Nepali liquor, kept in a black bag, were recovered.
Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in custody since 10.09.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Raxaul at Motihari, in connection with Adapur P.S.
