JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Informant, Mahesh Prasad Srivastava, under fear of threatening was directed to pay Rs.10,00,000/- (ten lacs) in lieu of rangdari by one Tiger claiming himself to be a shooter of renowned criminal Rajan Sahani by SIM No.8056954369. It has been submitted on behalf of petitioner that though chargesheet had already been submitted, but police had not tried to locate the owner of SIM No.8056954369, instead thereof, submitted chargesheet on the basis of so alleged inculpatory extrajudicial confessional statement. Furthermore, the aforesaid event along with criminal antecedent of petitioner has been taken into consideration by the learned lower Court while rejecting the prayer for bail. Patna High Court Cr.Misc. No.47572 of 2014 (02) dt.03-03-2015 custody since 07.08.2013.

On the other hand, learned Additional Public Prosecutor opposed the prayer.

Accordingly, petitioner Ramesh Kumar alias Tiger, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Devesh Kumar, Judicial Magistrate, 1st Class, East Champaran at Motihari in connection with Motihari Town P. S. Case no.118 of 2013, subject to condition that petitioner will have his physical presence at every fortnight before the Motihari Town P. S. till conclusion of instant trial and will file attendance slip before the learned Magistrate having so granted by the Town Police Station. In case of default, the learned Magistrate will be at liberty to pass appropriate order in accordance with law. To facilitate the conditions so imposed, the learned Magistrate will transmit a copy of the order upon Motihari Town Police Station. (Aditya Kumar Trivedi, J) Vikash/- U T
