JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 290, 272, 273 of the Indian Penal Code and Section 47 of Excise Act.

It is alleged that 25 litres country made mahua liquor was recovered from the house of the petitioner for which petitioner is in jail custody since 09.11.2016. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.993 of 2017 (2) dt.16-01-2017 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 536 of 2015.
