JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 269/270/272 of the Indian Penal Code and Section 47A of the Bihar Excise (Amendment) Act, 2016.

From the house of co-accused Shyam Narayan Singh country-made spirit was recovered by the authorities on 11.11.2015.

Submission of the petitioner is that recovery was not made from the possession of the petitioner and petitioner is in custody since 09.08.2016.

Considering the aforesaid fact, let petitioner,

Patna High Court Cr.Misc. No.48544 of 2016 (2) dt.19-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court, in connection with Kudra P.S. Case No.284 of 2015.
