In the present case, the petitioner is seeking bail in connection with Belganj P.S. Case No. 84 of 2016 for offences under Sections 302, 147, 148, 149 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the petitioner had moved before this Court for bail in Cr. Misc. No. 21379 of 2016 and this Court, vide order dated 20.5.2016, rejected the prayer of the petitioner for bail. The petitioner is in judicial custody since 29.02.2016. Looking to the period of custody as also the entire facts and circumstances of the case, let the petitioner, namely, Md. Dilshad Mian, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.51859 of 2016 (4) dt.08-03-2017 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateIII, Gaya in connection with Belganj P.S. Case No. 84 of 2016 subject to the condition that the petitioner will cooperate in the disposal of the case and if he remains absent on two consecutive dates, the court below will be at liberty to pass any order including cancellation of the bail.
