JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Section 30 of the Bihar Prohibition & Excise Act. Allegation is that from the possession of petitioners 20.25 litres of foreign liquor was recovered.

It has been submitted on behalf of the petitioners that they are in custody since 6.10.2016. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. It is alleged that 20.25 litres of foreign liquor is said to have been recovered from possession of petitioners. No compliance under Section 100 of the Code of Criminal Procedure is made.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail
