JUSTICE MADHURESH PRASAD ORAL ORDER 06-07-2021 In view of the sudden resurgence of Covid-19 infection, there is limited functioning of the High Court and, therefore, the matter has been listed today for consideration through virtual mode.
2 Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon to do so by the office.

4. The petitioners seek bail in Belaganj PS Case No. 292 of 2020,instituted for the offence under Sections 147,148,149,341,323,384,504 and 506 of the Indian Penal Code.

5. FIR named accused persons along with 10-15 other persons, armed with 'Lathi' 'Danda' gun and rifle were intercepting the trucks. It is alleged that they were demanding ransom from the informant who was driving the truck. There is alleged snatching of some cash (Rs. 10,000) from his pocket.
6. The learned counsel for the petitioners submits that the allegations are false. The petitioners have no criminal antecedents and could not indulge in such activities. A road rage arising out of taking over/ pass in front of the petrol pump has led to an altercation between the parties whereafter the petitioners along with others have falsely been implicated. The other co-accused persons, namely Sanjeet Kumar Singh and Bhola Kumar have been allowed bail in Cr. Misc. Nos. 33113 of 2020 and 1792 of 2021 respectively. The petitioners are in custody since 11.09.2020.
7. The learned APP representing the State has opposed the prayer for bail.

Considering the rival submissions, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya, in connection with Belaganj PS Case No. 292 of 2020, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.
(ii) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail
