JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending his arrest in connection with Mahishi P.S. Case No. 32 of 2015 for the offences instituted under Sections 341, 323, 354, 406, 504, 506 of the IPC and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The informant alleged that the accused persons came and took Rs. 50,000/- from her for appointing her son, but her son was appointed on salary of Rs. 5,000/- and later on he was removed from his service.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted
Patna High Court Cr.Misc. No.29776 of 2015 (2) dt.29-07-2015 2/2 that the petitioner has falsely been implicated in the present case. It is further stated that the alleged occurrence is said to have taken place on 07.01.2015 but the complaint was filed on 28.01.2015 for which no explanation has been made on behalf of the prosecution. Other co-accused has been granted bail vide Cr. Misc. No. 25704 of 2015.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Mahishi P.S. Case No. 32/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U.K./- (Sudhir Singh, J) U T
