JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 324, 385, 307, 379 and 506 of the I.P.C.

The prosecution story, in brief, is that on the alleged date and time of occurrence while the informant along with one Niwas Kumar were giving tuition to the student, then suddenly the petitioner having arms entered into coaching and demanded rangdari from the informant. When he refused, the petitioner gave knife blow to the informant on his back and snatched his golden chain.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.2.2016 and the charge sheet has

There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The alleged occurrence is said to have taken place due to petty dispute between the parties. The petitioner has remained in custody for more than 10 months. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. case No.107 of 2016.
