Patna High Court Cr.Misc. No.30742 of 2015 (2) dt.11-08-2015 11-08-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in connection with Chousa P.S. Case No. 31 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 307, 353, 427 and 120(B) of the Indian Penal Code.
Learned counsel for the petitioners submits that at best, they can be treated as members of the MOB and no specific role has been assigned to any of them. Considering the nature of allegation made against the petitioners and also the fact that they have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Uda Kishunganj, Madhepura in connection with Chousa P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
