2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 354, 379 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.
3. As per the prosecution case, this petitioner along with other accused persons entered into house of the informant and misbehaved with female members of the family and looted gold ornaments on the point of pistol. It is further alleged that co-accused, Kundan Singh fired which hit in the right eye of the informant thereafter the accused persons, including this petitioner, made indiscriminate firing.
4. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been
Patna High Court CR. MISC. No.55996 of 2023(2) dt.30-08-2023 2/2 implicated in the case. It is further submitted that specific accusation of firing and causing injury in the eye of informant is against co-accused, Kundan Singh. So far this petitioner is concerned allegation is general and omnibus.
5. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
6. Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additionla Chief Judicial MagistrateIII, Vaishali at Hajipur in connection with Jurawanpur PS case No. 194/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
