JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two tempos were intercepted by the police officials having got confidential information. From one tempo being driven by the petitioner, 40 bottles of country made liquor kept in a sound box were recovered from the back seat of the tempo. Similarly, on another tempo being driven by Rajendra Prasad, one co-accused Manish Kumar was found sitting and in huge quantity, Indian made foreign liquor were recovered from possession of the aforesaid Manish Kumar.

Submission on behalf of the petitioner is that the so called seized bottles were kept in a sound box and petitioner was not aware about the same and as a matter of fact, co-accused

Patna High Court Cr.Misc. No.38492 of 2016 (2) dt.16-09-2016 2/2 Manish Kumar had hired tempo of the petitioner for carrying his luggage.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati ( Dobhi) P.S.Case No. 288 of 2016.
