The sole petitioner, who is in custody since 7.4.2016 has prayed for grant of bail in Sessions Trial No. 542 of 2016 arising out of Agamkuan P.S. Case No. 118 of 2016 ( G.R. No. 1148 of 2016) registered for the offence under Section 399, 402 of the Indian Penal Code and Section 25 (1- b) A , 26, 35 of the Arms Act.
Earlier a report was called for from the court below regarding present stage of the case which has been received and kept at flag "A" . Report suggests that charge has already been framed and case is fixed for evidence. On perusal of paragraph no.
Patna High Court Cr.Misc. No.40997 of 2016 (3) dt.19-10-2016 2/2 3 of the petition it is evident that petitioner is accused in number of cases. Since trial has already commenced and petitioner is accused in number of cases, there is no reason to extend the privilege of bail.
The petition stands dismissed.
