JUSTICE RAKESH KUMAR ORAL ORDER 29-09-2016 Heard Sri Sanjeev Kumar, learned counsel for the petitioner and Sri Umesh Lal Verma, learned Additional Public Prosecutor The petitioner who is in custody since 2.7.2016 in Excise Case No. 187 of 2016 [CIS Filing No. Excise 4412 of 2016 and CIS Registration Excise 178 of 2016] for offence under Section 47(A) of the Bihar Excise Amendment Act 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has been made accused on an accusation of possessing about 16.125 liters of foreign liquor . It was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and this fact has been stated in paragraph no. 3 of the petition.

Patna High Court Cr.Misc. No.40823 of 2016 (2) dt.29-09-2016 2/2 Keeping in view the nature of accusation and clean antecedent of the petitioner , let the petitioner Sandip Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah / concerned court in connection with Excise Case No. 187 of 2016 [CIS Filing No. Excise 4412 of 2016 and CIS Registration Excise 178 of 2016].
