This application, for grant of anticipatory bail, arises out of Barachatti Police Station Case No. 555 of 2019, corresponding to G.R. No. 1550 of 2019, disclosing offences under Sections 364, 34 of the Indian Penal Code. It has been submitted by learned counsel for the petitioners that the deceased went along with the petitioners and he has died in an accident. There is no reason for the petitioners to kill the deceased. The dead body of the deceased was

Patna High Court CR. MISC. No.9646 of 2021(4) dt.18-01-2022 2/2 recovered after 21 days. Post-mortem could not be done because of the nature of dead body. It has also further been submitted that there is delay of three days and there is no mention of any enmity in the FIR and this also supports the case of the petitioner that the deceased died in an accident. Considering the aforesaid facts that there is no material against the petitioners to connect or to show that they have participated in the killing of the deceased, the application for anticipatory bail is allowed.

Let the petitioners, named above, in the event of their arrest or surrender before the Court below within eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Barachatti Police Station Case No. 555 of 2019, corresponding to G.R.
