====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in G.R.P. (Patna Sahib) P.S. Case No. 216/2018, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.

It is alleged in the written report that the informant was travelling in train and as soon as the train started from Patna Sahib Railway Station, a boy gave danda blow on his hand due to which his Samsung mobile fell down on the ground. Thereafter taking the mobile, aforesaid boy started running away. On hulla raised by informant, the boy was caught and his mobile was recovered.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.64579 of 2018 (2) dt.29-10-2018 2/2 he has been falsely implicated in this case on the basis of suspicion. There is no recovery from his possession. He has clean antecedent. He is in custody since 03.07.3018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway, Patna in connection with G.R.P. (Patna Sahib) P.S. Case No. 216/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
