Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a)/41 of the Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 19.06.2019. 3.780 litres of foreign liquor was recovered from the house of the petitioner. Petitioner has got identical criminal antecedent. In the past, prayer for bail was refused.

Report of the learned Trial Judge dated 24.12.2019 reveals that the trial has witnessed no progress. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the

No.50001 of 2019(4) dt.19-02-2020 2/2 satisfaction of learned Court below where the case is pending in connection with Biraul Police Station Case No. 163 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
