The petitioner seeks bail in connection with Shahkund (Sajour) P.S. Case No. 111 of 2015 registered under Sections 328 and 394 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 05.02.2016 passed in Cr. Misc. No. 57344 of 2015.
It is contended that though the petitioner is in custody since 10th September, 2015, he has not been put on T.I. Parade during investigation and even charges have not been

It is further contended that another co-accused, namely, Shakho Das @ Prashan Kumar whose name also transpired in confessional statement has already been granted bail by this Court vide order dated 30.11.2015 passed in Cr. Misc. No. 53882 of 2015.
On the other hand, learned counsel for the State has opposed the application for bail. He has submitted that since the petitioner has been named in the FIR, the contention that he was not put on T.I. Parade during investigation is of no relevance. However, he concedes that another co-accused having more or less identical allegation has already been granted bail by a co-ordinate Bench of this Court.
Regard being had to the aforesaid submissions, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bhagalpur in connection with Sahkund (Sajour) P.S. Case No. 111 of 2015.
