Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL ORDER 09-12-2022 In the instant petition, petitioner is seeking for Regular Bail in connection with Compl. Case No. 850(c)/2021, for offence under Section 406/420 of I.P.C.
In Para 8 of the petition he has stated as under:- "That petitioner is ready to settle the account with complainant according to what he has received."
In the light of the aforesaid statement made by the petitioner. The petitioner has been granted Regular Bail arising out of Complaint Case No. 850(c) of 2021 for offences under Section 406/420 I.P.C, pending on the file of the Judicial Magistrate, 1st Class, Danapur. It is noticed that petitioner would be settling the account of the complainant, therefore, Regular Bail has been granted with a condition that he would

In the event of non-settling within one month in that event the informant is permitted to make an application for cancellation of Regular Bail. In the light of these facts and circumstances, petitioner has made out prima facie for grant of regular bail. Accordingly, bail application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur, in connection with Complaint Case No. 850(c)/2021, subject to following conditions:- (i) The petitioner shall co-operate in investigation and in conclusion of the trial.
(ii) He shall remain present on each and every date of trial till conclusion of trial.
(iii) He shall not try to tamper with the evidence or intimidate the witness to delay the conclusion of trial. (iv) In the event of default of two consecutive dates without any valid reasons, his bail bonds is liable to be cancelled.
(v) The Court below shall verify the criminal

No.52579 of 2022(2) dt.09-12-2022 3/3 antecedent of the petitioner and in the case, at any stage, it is found that petitioner had concealed his criminal antecedent, the court below or investigating authority shall take immediate step for cancelling bail bond of the petitioner.
