The petitioner seeks bail in a case instituted under Sections 406, 409 and 420 of the Indian Penal Code. The allegation against the petitioner is of misappropriation of government money to the tune of Rs. 3, 83, 866/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged amount of Rs. 3, 83, 866/- has already been deposited by the petitioner, which is

Patna High Court Cr.Misc. No.42273 of 2016 (2) dt.04-10-2016 2/2 evident from the order of the Sessions Court. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Simri P.S. Case No. 09 of 2016.
