Earlier case diary was called for in this case which has been received.

The petitioner being second wife of the husband of the deceased is apprehending her arrest in a case registered for the offence punishable under section 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is the sister of deceased and she has been married with the husband of the deceased on account of the fact that she was not able to give birth a child and with her consent the marriage took place. Learned counsel further submits that thereafter there has been issue between the petitioner and her husband and also a daughter was born from the deceased. It is only on account of

Patna High Court Cr.Misc. No.29667 of 2015 (5) dt.02-12-2015 2/2 that there has been some quarrel and she in fact has herself committed suicide by hanging herself.

Learned counsel appearing on behalf of the State has referred to paragraph 7 of the case diary which indicates that in fact it was a case of hanging but the postmortem report does not indicate any other external injury to indicate that the deceased had in fact been hanged to death by other and perhaps it was a case of suicide.

Considering the facts and circumstances of the case let the above named petitioner in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional District & Sessions Judge Vth , Patna in S.T. No. 197 of 2015 arising out of Dhanarua P.S. Case No. 357 of 2014, subject to the conditions laid down under section 438(2) Cr.P.C.
