Petitioners seek bail in Gogari P.S. Case No.258/18 registered for the offence under Sections 448, 307, 120(B)/34 of the I.P.C. and Section 27 of Arms Act.

Allegation against the petitioner no.1 is that he fired at the informant which did not hit him.

Submission on behalf of the learned counsel for the petitioners is that the F.I.R. itself shows that they are in custody since 3.8.2018 and moreover for the same occurrence a case being Gogari P.S. Case No.259/18 was registered under Sections 25(1B)a/26 of Arms Act against the petitioners. Heard the learned A.P.P. and the informant who opposed the prayer for bail of the petitioners.

No.64322 of 2018 (2) dt.26-10-2018 2/2 Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria, in Gogari P.S.
