JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Gopalpur P.S. Case No. 157 of 2017 dated 04.11.2017 instituted for the offences under Section 392 of the Indian Penal Code.

Though the petitioner has not been named in the F.I.R and his name has transpired only in the confession of a co-accused, but it appears that with respect to the same occurrence, another case was lodged vide Chanpatia P.S. Case No. 406 of 2017under Section 392 of the Indian Penal Code.

Considering the aforesaid facts, this Court is not

Patna High Court Cr.Misc. No.64107 of 2018(2) dt.14-12-2018 2/2 inclined to grant anticipatory bail to the petitioner. The petitioner may surrender before the learned Court below and pray for regular bail.

Should such an application be filed before the Court below within a period of four weeks from today, learned Court below shall take into account all the material facts and pass orders without being prejudiced to the fact that the present anticipatory bail petition has not been entertained by this Court.
