JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 18(c), 27(b), 17B (e), 18(a)(i), 27(a), 22(cca), 22(3), 28, 18(a)(vi) and 27(d) of the Drugs and Cosmetic Act, 1940 in connection with Bairiya P.S. Case No. 11/2016.

It is submitted that there is no independent witness of the occurrence and now charge-sheet has already been submitted. The petitioner is an unemployed person who is ready to co-operate in the investigation.

However, in view of materials available, I am not inclined to enlarge the petitioner, above named, on anticipatory

Patna High Court Cr.Misc. No.55155 of 2016 (2) dt.13-01-2017 2/2 bail in connection with Bairiya P.S. Case No. 11/2016. Accordingly, the same is rejected and as charge-sheet has already been submitted in the court below, the petitioner may move for bail before the learned court below, who shall examine the matter in detail and shall pass appropriate order without being prejudiced by this order preferably on the same day. With the aforesaid observation, the petition is disposed of.
