JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-08-2019 A suit being Title Suit No. 145 of 2014 is pending before the Munsif, Sherghati. It is the case of the petitioner that for just adjudication of the title suit, Chakbandi map of village Bishunpur, P.S. Bankey Bazar, Thana No. 287, in the district of Gaya is essentially required, which is not available. In that background, this writ application has been filed, seeking a direction to the authorities to provide Chakbandi map. Admittedly, the title suit is pending before a Civil Court of competent jurisdiction. The Court has authority to
Patna High Court CWJC No.15656 of 2019(2) dt.01-08-2019 2/2 summon the document for just adjudication of the case, if the same is felt necessary.
I am not inclined to entertain this writ application as, in substance, the application seeks something to be done to aid proper adjudication in a title suit, which is pending, though such power lies there in the Civil Court.
This writ application is accordingly dismissed. The petitioner shall be at liberty to approach the Civil Court or any other authority for obtaining the required document.
