The petitioner apprehends his arrest in connection with Shivhar P.S. Case No.168 of 2020 registered for the offences under Sections 406 and 420 of the Indian Penal Code. Considering the fact that cheque of Rs.16,00,000/- has bounced and only Rs.4,00,000/- has been repaid to the informant and Rs.12,00,000/- is still due, it is not a fit case for grant of anticipatory bail. Prayer for anticipatory bail is hereby rejected.
Patna High Court CR. MISC. No.10850 of 2021(3) dt.15-12-2021 2/3 On 07.12.2021 following order was passed by this Court which is quoted hereinbelow:
"Learned counsel for the petitioner will seek instruction in this case to pay the balance amount in a week or on the next date, the case shall be heard on merit and decided.
This order has been passed in presence of Mr.Dinesh Jha, learned counsel for the informant who is a lady and has been cheated. Put up this case on 15.12.2021 at 02.15 p.m."
Petitioner is directed to surrender in the court below within a week. If the petitioner does not surrender in the court below within a week, the Superintendent of Police, Sheohar is directed to take all coercive steps for arresting the petitioner and if the petitioner does not surrender within a week, S.P. Sheohar is directed to submit his report after two weeks from today. He shall also seek information from the Senior Superintendent of Police, Patna as to how many cases, the petitioner is accused in duping the innocent persons on this score.
Let a copy of this order be communicated to the Superintendent of Police, Sheohar for its compliance through FAX message immediately.
The Superintendent of Police, Sheohar is directed to form a Special Investigation Team for this purpose within a week.
