2. The petitioners are apprehending their arrest in connection with Bahadurpure P.S. Case No. 169 of 2022 dated 26.04.2022, registered for the offences punishable under Sections 30(a)/32(ii)(iii)/36 and 41(i) of Bihar Prohibition and Excise Act and under Sections 420, 467, 468, 471, 414 and 120 (B) of the Indian Penal Code pending in the Court of learned Exclusive Special Judge-1 (Excise Act), Darbhanga.
3. After some arguments, learned counsel for the petitioners seeks permission to withdraw this application.
4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.
6. However, if the petitioners surrender before the learned Court below within a period of six weeks from today and seek regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that the petitioners were not present at the place of occurrence and petitioner no.1 is working in Chennai and petitioner no.2 is an auto driver of the auto which was registered in the name of his father. The said auto was not present at the place of occurrence.
