2. The petitioner seeks regular bail in the present case registered for the offence under Sections 8©, 21(b), 21(c) of the NDPS Act.
3. As per the prosecution case, there is recovery of 102 gram of heroine from the possession of the petitioner
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 06.06.2024 and has clean antecedent.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the period of custody and clean
Patna High Court CR. MISC. No.58772 of 2024(3) dt.20-11-2024 2/2 antecedent, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnia/concerned Court below in connection with Sarsi P.S. Case No. 104 of 2024 subject to condition that:- 7(i). The petitioner will mark his attendance at the Banmankhi Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
