The present writ petition has been filed for quashing part of the resolution dated 20.06.2012 by which the petitioner has been declared as "not qualified", having been granted zero marks under the head "capability to provide land and other facilities" and also marks for "fixed and movable assets" as well as "income".

3. Learned counsel for the petitioner submits that after scrutiny the petitioner was called for interview. Moreover, it is submitted that in view of various documents supporting the claim of the petitioner under the three heads aforesaid, there could be no justification for the award of zero marks thereunder.

4. Learned counsel for the respondent-Corporation

Patna High Court CWJC No.13263 of 2012 dt.16-09-2016 2/2 opposes the writ petition and relies on the counter affidavit to submit that the requisite documents in support of the petitioner's claim under three heads were not in order and not enclosed with the application.

5. Be that as it may, with the consent of the parties, the writ petition is disposed of granting liberty to the petitioner to file a representation before the State Coordinator, Bharat Petroleum Corporation Limited, Patna within a period of two weeks from today. If any such representation is filed within the stipulated period, the same shall be considered and disposed of on its own merit in accordance with law.
