The petitioner seeks bail in a case instituted for the offences under Sections 364, 302 and 120(B) of the Indian Penal Code.
Earlier the petitioner has moved before this Court for grant of bail vide Cr. Misc. No.8272 of 2016 and vide order dated 21.4.2016 his prayer for bail was rejected. Allegation has been made by Geeta Devi that she got information by his nephew that her husband was going alongwith Pankaj Kumar and Sri Kant Raut, were followed by Satyendra Raut and whereafter dead body of the victim was
Patna High Court Cr.Misc. No.42865 of 2016 (9) dt.08-08-2017 recovered. During investigation four persons were arrested, namely, Amarendra Pandey, Chandan Singh, Sonelal Paswan @ Ganaur Paswan and Anand Mohan Singh. They are contract killer having received Supari from Sanju Devi whereafter this victim was picked up from the market and carried to the bank of the river where brutally killed the victim.
Learned counsel for the petitioner submits that following persons have been granted bail by this Court. One Amarendra Pandey was involved in commission of the offence has been granted bail by this Court. Sanju Devi has been granted bail by this Court vide Cr. Misc. No.32291 of 2016 and Pankaj Kumar has also been granted bail vide Cr. Misc. No.29548 of 2016. Petitioner is in jail since 29.11.2015.
Having considered the facts and circumstances of the case, let petitioner, Srikant Raut, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 8th, Motihari in connection with Patahi P.S. Case No. 195 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner i.e. father, brother, son or wife and (ii) petitioner would participate in the court proceeding and in the
Patna High Court Cr.Misc. No.42865 of 2016 (9) dt.08-08-2017 event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner. Let record of Cr. Misc. No.13303 of 2017 be returned to the office.
