Petitioner is not named in the first information report and the learned Sessions Judge, Aurangabad referred several paragraphs of the case diary to show the involvement of the petitioner in the present crime though he has not indeed referred the materials which are contained in the aforesaid paragraphs of the case diary. However, the case diary is available and the learned counsel appearing for the petitioner having gone through the case diary submitted that except suspicion, there is nothing on the record and it has only come against the petitioner that he used to

Patna High Court Cr.Misc. No.40842 of 2016 (3) dt.23-11-2016 2/2 provide meal to extremists and hatched conspiracy for commission of the present crime. It is further submitted that petitioner does not have any criminal antecedent and, as a matter of fact, he has been implicated in this case on account of village politics. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Deo P.S.Case No. 29 of 2016.
