JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-12-2021 Heard the learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Dhansoi Police Station Case No. 163 of 2020, disclosing offences under Sections 341/427/353/307/34 of the Indian Penal Code.

The allegation against the petitioner is that he interpolated his certificate by committing forgery and made his date of birth as 05.01.1975 in place of 05.01.1972 and became successful in obtaining the job of Shiksha Mitra. The learned Counsel for the petitioner has submitted that entire allegation is false and he did not commit any forgery. In impugned order, it has been mentioned that

Patna High Court CR. MISC. No.9034 of 2021(2) dt.21-12-2021 2/2 during inquiry, it was detected that the petitioner has become successful in getting the job after making forgery in his certification, as such, it is not a fit case for anticipatory bail. Accordingly, the prayer for anticipatory bail is hereby rejected.

If the petitioner files regular bail that should be disposed of on its own merit preferably and if possible on the date of filing of the petition.
