The petitioner seeks bail in a case registered for offences punishable under Section 25(1-b) /26 of Arms Act. As per allegation, petitioner was apprehended from his house along with four live cartridges and two empty cartridges.

It is contended that two cases were instituted on the same day. The present case was instituted under Section 25(1-b) a/26 of the Arms Act, whereas Gogri P.S. Case No.258 of 2018, was registered under Section 341/448/307/120(B)/34 of the I.P.C. There is alleged recovery of 4 live cartridges and two empty cartridges from the possession of the petitioner. It is

Patna High Court Cr.Misc. No.62767 of 2018(2) dt.08-10-2018 2/2 contended that except the aforesaid case which was instituted on the same day, petitioner is not involved in any other case. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail after completion of 3 months in custody on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Gogri (Paura O.P) P.S. Case No. 259/2018, G.R. No. 2117/2018. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
