2. Petitioner seeks regular bail in connection with Harlakhi P. S. Case No. 39/2025 in a case registered for the offences punishable under Sections 274, 275, 317(5), 3(5) of the Bharatiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, 405 liters illicit liquor was recovered from the seized motorcycle.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is neither driver nor owner of the motorcycle in question. Petitioner has been made accused only
Patna High Court CR. MISC. No.53108 of 2025(2) dt.19-09-2025 2/2 on suspicion. Petitioner is in custody since 13.06.2025. Chargesheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise, Madhubani in connection with Harlakhi P. S. Case No. 39/2025.
