Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A, 34 of the Indian Penal Code and sections 12 of the POCSO Act.
It is a case of sexual assault of a minor girl of the daughter of the informant. After recovery of the victim girl, she stated in her statement under Section 164 Cr.P.C. that this
Patna High Court CR. MISC. No.62872 of 2021(2) dt.18-05-2022 2/2 petitioner committed wrong with her. Petitioner taken away to her Calcutta and committed wrong and left to Mohanpur. It is submitted that false implicated in this case and there has delay of 13 days in lodging the F.I.R.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has been falsely implicated in this case.
Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner. Considering the fact that the victim is minor and she specifically alleged against the petitioner to have outraged her modesty, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected. (Sunil Kumar Panwar, J) Ranjeet/- U T
