The petitioner seeks bail in Teghra P.S. Case No. 476 of 2018, instituted for the offence under Section(s) 25(1B)A, 26 and 35 of the Arms Act. It is alleged in the written report that Police got information that 3-4 persons boarded in white colour Xylo Car bearing Registration No. BR01PE-0388 going from Begusarai towards Teghra at NH28 who may commit crime. The petitioner reached the place of occurrence and intercepted Xylo car in which four persons were found sitting. They were arrested by the police. They disclosed their names as Md. Islam, Shabana Khatoon, Md. Amjad and driver Md. Sarfaraz Nadaf @ Raja.
Patna High Court CR. MISC. No.48878 of 2019(2) dt.09-08-2019 2/2 Counsel for the petitioner submits that name of petitioner has been disclosed by co-accused Md. Islam who was found sitting in the car. He further submits that there is no recovery from possession of the petitioner.
Petitioner is in custody since 10.2.2019.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, Distt. Begusarai, in connection with Teghra P.S. Case No. 476 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
