Petitioners are apprehending their arrest in connection with Gauri Chak P. S. Case no. 48 of 2015 registered under Section 302/34 of the Indian Penal Code.
Earlier case diary of the present case has been called for and it has been received.
Learned counsel for the petitioners submits that although there was a marpit but the doctor found only three injuries on the person of the deceased, of which two are simple in nature. Learned counsel for the State after going through the case diary does not find any specific act to have been attributed to the petitioners.
Considering the facts and circumstances, let petitioners above named, in the event of arrest or surrender within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/-
Patna High Court Cr.Misc. No.28480 of 2015 (3) dt.15-09-2015 2 / 2 (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar No. IV, learned Judicial Magistrate, Patna City, District-Patna, in connection with Gauri Chak P. S. Case no. 48 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
