1. Heard the parties.

2. The petitioner is a borrower of a tractor for which loan was given to the petitioner in the year 2006 by Uttar Bihar Gramin Bank, Branch- Koilakh , District- Madhubani.

3. The grievance of the petitioner is that when the tractor agency delivered the tractor to the petitioner in the year 2006 they did not provide trailor or cultivator, sale letter and other accessories due to which the tractor remained idle at the door of

The petitioner immediately after receiving the tractor issued legal notice dated 08.01.2007 to the Uttar Bihar Gramin Bank to provide the aforesaid accessories but no step whatsoever was taken. Suddenly, in the year 2017-18 a certificate case bearing Certificate Case No. 04 / 2017-18 was initiated against the petitioner in which the petitioner submitted his objection on 25.11.2024. The Certificate Officer, Madhubani without considering the objection of the petitioner in correct factual and legal perspective has rejected the objection and confirmed the certificate for payment of Rs. 5,18,965/- within fifteen days.

4. Learned counsel for the Uttar Bihar Gramin Bank submits that a detailed reasoned order has been passed by the Certificate Officer, Madhubani after considering the objection of the petitioner, however, there is provision for appeal before the District Magistrate.

5. Considering the aforesaid submissions, the present writ application is disposed with liberty to the petitioner to file appeal before the respondent no. 2 / District Magistrate, Madhubani. If any such appeal is filed within fifteen days from today, the District Magistrate, Madhubani shall dispose the same in accordance with law on its own merit after giving opportunity
