JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2020 The petitioner seeks regular bail in connection with Katihar Town P.S. Case No. 265 of 2019, registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is of assault to one Md. Babar by means of Bhala causing his death. It has been submitted on behalf of the petitioner that the F.I.R. itself shows that the petitioner was assaulted by Khanti, thereafter, the petitioner also assaulted in his right to private defence and further, there was no intention of the petitioner to kill anyone. Further, he has no criminal antecedent and he has been in custody for more than ten months. Heard learned A.P.P. also.
